Is a high-cost installment loan legal in Idaho? Yes. An installment loan is a personal loan you repay in fixed payments over months, and Idaho sets no fixed ceiling on its rate. Under Idaho Code § 28-42-201, the finance charge on a licensed consumer loan is "that which is agreed upon between the parties to the transaction." The contract sets the price.

The state controls two other things: who may lend, and how long repayment can run on small loans. If you have one of these loans open while you are closing on a house, it will also show up in your mortgage file.

Who licenses these lenders, and what the law limits

Installment lenders fall under the Idaho Credit Code. They are licensed by the Idaho Department of Finance's Consumer Finance Bureau under a Regulated Lenders License. The license costs $350 per location, and the lender must show at least $30,000 in liquid assets.

A lender does not need an office in Idaho to hold the license. The department states that a physical location is not required, so an online lender lending to Idahoans answers to the same licensing rule. Banks and credit unions are exempt.

For loans of $1,000 or less, Idaho Code § 28-43-310 requires substantially equal payments at equal intervals. The one exception is a schedule adjusted to seasonal or irregular income. The same section caps how long repayment can run.

Where the price lands without a cap

In 2026, Rep. Bruce Skaug testified that he had seen short-term loans in Idaho charging 200% to 300% interest, BoiseDev reported. His bill, House Bill 649, would have capped voluntary loan contracts at 30% or at the prime rate plus 10 points, whichever is greater. On March 25, 2026, the bill was sent back to committee. It got no floor vote before the session ended on April 2.

As of late September 2026, the Department of Finance had announced no rate-cap change. The one hard ceiling in the sources is federal. Borrowers covered by the Military Lending Act are protected by a 36% Military Annual Percentage Rate.

The sources do not say how many Idaho lenders use bank partnerships or tribal status. They do not list credit union payday-alternative loans or state assistance programs either. Before you sign, ask the department whether the lender holds a license: 208-332-8002 or icc.mail@finance.idaho.gov.

Not the same as a payday loan

Payday lenders need a separate Regulated Payday Lender License. Their loans also carry limits that installment loans do not. A payday loan can be no more than $1,000 and no more than 25% of your gross monthly income. Once a year, you can ask for an extended plan of four equal payments over 60 days. If you are closing on a house soon

An underwriter reads your bank statements line by line. A recurring payment to a consumer lender will be noticed, and so will a recent deposit of the loan proceeds. Expect a request for a letter of explanation that says what the loan was for and what you owe.

The monthly payment counts toward your debt-to-income ratio, which compares your monthly debts with your gross income. On a tight file, one payment can decide whether you qualify.

If you can pay the loan off, do it before you apply, and keep the payoff letter. If you are already under contract, ask your loan officer first. A large payment out of your account can raise its own question about your cash to close. How each item is treated depends on your lender.
