Can you get a legal payday loan in West Virginia? In practice, no. State law caps small consumer loans at a rate no payday business can survive on, and a separate statute bans the post-dated check arrangement the product is built on.
This matters if you are a few weeks from closing and short on cash for a repair, a gap or moving costs. A lender offering a West Virginia resident a two-week loan for a flat fee is either describing its product falsely or ignoring state law.
Two statutes close the door
The first is W. Va. Code §46A-4-107, part of the West Virginia Consumer Credit and Protection Act (the legislature's posted version is dated June 24, 2026). It limits licensed lenders to "31 percent per year on the unpaid balance" for unsecured loans of $3,500 or less, or 31% plus a nonrefundable processing fee of up to 2% of the amount financed. Payday loans in states that allow them average close to 400% APR, according to the Center for Responsible Lending (2022 data, published February 2025).
The second is W. Va. Code §32A-3-1, the check-cashing law. It forbids a business to "agree to hold checks submitted to them for deposit at a later date for the purpose of providing a loan of money." That is the deferred-deposit loan, outlawed by description.
Any lender charging more than 18% a year must be licensed as a Regulated Consumer Lender by the West Virginia Division of Financial Institutions (dfi.wv.gov). Other lenders, the DFI says, are held to 18%.

Where the ban shows up
Online and tribal lenders are the usual test. In November 2015 the Attorney General reached a $13 million settlement with CashCall, a lender tied to tribal lending arrangements that had charged West Virginians 59% to 96% and made about 84,371 collection calls to residents, according to TribalLenders.com. The same source reports a West Virginia court found that Payday Financial lacked genuine tribal status and could not claim sovereign immunity, and that many online and tribal lenders now exclude the state entirely.

A small installment loan is a different thing
A licensed finance company can legally lend you $1,000 at up to 31% a year, repaid over time. That is not a payday loan. What makes a loan illegal here is the rate above the cap or the held-check structure, not the size.

How an underwriter will read it
If you are under contract, any short-term loan shows up where your lender is already looking. Regular debits to a lender on your bank statements tend to draw a request for a letter of explanation. An open loan with a monthly payment goes into your debt-to-income ratio. Paying it off before you apply, and keeping the payoff record, removes both questions, though each lender sets its own documentation rules.
If you already borrowed from an online lender at a triple-digit rate, that loan may break West Virginia law. Contact the DFI before you pay more than you owe, and tell your loan officer now rather than at underwriting.
