Is payday lending legal in Delaware? Yes. The state allows payday loans, which its law calls short-term consumer loans, and it does not cap what they cost. What the law limits is how much you can borrow, how often, and how many times a loan can be rolled over.
If you are weeks from closing on a house, that matters for a second reason. A payday loan leaves a trail on the bank statements your mortgage lender is about to read.
How Delaware's payday rules work
The rules sit in Title 5, Chapter 22, Subchapter III of the Delaware Code. Section 2227 defines a short-term consumer loan as one of $1,000 or less, with a stated repayment period under 60 days, that is not secured by a car title.
The current framework came from House Bill 289, which Governor Markell signed on June 27, 2012. It raised the ceiling from $500 to $1,000, set the five-loan limit and created a real-time state database. Lenders must be licensed by the Office of the State Bank Commissioner, and they must check that database before lending.

The limits have teeth. A loan made in breach of the count or rollover rules is void, and the lender cannot collect principal, interest or fees. Lenders also may not pursue or threaten criminal action over nonpayment.
No rate cap means no rate cap
Delaware does have a general usury limit, about 8.75% when LegalClarity described it, but licensed payday lenders sit on a separate track that limits rollovers instead of rates. The only check on price is a general unconscionability standard.
The result: the Center for Responsible Lending put Delaware payday APRs near 400%, as Delaware Business Now reported in 2023. Bills to cap rates at 100% (2016) and 20% (2021 and 2023) all stalled.
Online lenders and cheaper options
Our sources do not cover online or tribal lenders lending into Delaware, credit union payday-alternative loans, or state assistance programs, so we will not guess at them.
What the law does give you is a check. Any lender offering these loans must post its fees on its website with the statement "A payday loan is not intended to meet long-term financial needs." A site without it is a warning sign. The OSBC's licensing line is (302) 739-4235, Option 1.
What an underwriter sees before closing
Every repayment shows up as a debit on your bank statements, and recurring debits to a short-term lender tend to draw a request for a letter of explanation. Whether an open payday loan counts in your debt-to-income ratio depends on your lender and loan program; ask your loan officer directly.
The cleanest path is to pay it off before you apply. If you took one out yesterday, Delaware's next-day right to cancel lets you return it without fees. And do not take a new one between contract and closing.
